Water Terms & Conditions

1. Eligibility

You must be at least 13 years old to use Water.

If you are between 13 and 18, you may only use Water with the consent of a parent or legal guardian who agrees to these Terms on your behalf.

By creating an account, you represent that you meet these age requirements.

2. Platform Role

Water provides technology for live video, checkout, and payments.

Water does not:

• Sell or fulfill products
• Provide services or professional advice
• Employ sellers or professionals

All products and services are offered directly by Sellers.

4. Selling, Sessions & Services

By selling or offering sessions, consultations, coaching, or services, you confirm that:

• You are legally permitted to offer them
• You are responsible for accuracy, delivery, and outcomes
• You hold any required licenses or certifications
• Buyers are responsible for determining suitability

Water does not verify credentials unless explicitly stated.

5. Shipping & Fulfillment

• Physical goods must be shipped within 2 business days, unless disclosed otherwise
• Tracking should be provided when available
• Digital goods and sessions must be delivered as described

6. Prohibited Items & Activity

You may not use Water to sell or promote:

• Counterfeit or infringing goods
• Illegal, regulated, or restricted products or services
• Hazardous or unsafe items
• Misleading, deceptive, or fraudulent listings
• Activity that violates laws or platform policies

7. Disputes & Chargebacks

• Buyers and Sellers should resolve issues directly when possible
• Disputes or chargebacks may result in payout holds or restrictions
• Payment provider decisions are final
• Water does not guarantee dispute outcomes

8. Enforcement & Account Standing

Water may take action if these Terms are violated, including:

• Content removal or warnings
• Feature restrictions or payout holds
• Account suspension
• Account termination

Enforcement decisions are final.

9. Additional Features & Policies

Some Water features may have additional terms, including:

• Tipping
• Promotions or coupons
• Subscriptions
• Events or ticketed access
• Affiliate or referral programs

By using these features, you agree to any applicable supplemental terms.

10. Intellectual Property

• You retain ownership of content you create and upload to Water
• By posting content, you grant Water a license to display, distribute, and promote it on the platform
• You may not use Water's name, logo, or branding without written permission
• You may not copy, scrape, or reproduce content from other users without their consent

11. Disclaimer

Water is provided "as is."

Water is not responsible for:

• Product quality or service results
• Fulfillment or delivery
• User conduct
• Payment provider delays or decisions

12. Limitation of Liability

To the maximum extent permitted by law, Water and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

Our total liability for any claim related to the platform shall not exceed the amount you paid to Water in the 12 months preceding the claim.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Delaware.

14. Updates

These Terms may be updated at any time.

Continued use of Water means you accept the latest version.
